Electronic Evidence Preservation

Oftentimes, NTI is retained to spearhead electronic discovery efforts, whether responsive data is active or ambient. Other times, we are retained to assist other firms in collection of potentially responsive data from a variety of electronic media, including magnetic tapes, hard drives, PDAs, and other forms of archival data storage.

Electronic data is very fragile; metadata (data about the data, such as when a file was created, accessed or modified) changes each time the computer is used. It’s far more preferable to preserve everything and process a small portion of the available universe of data than to allow portions of potentially critical information to disappear forever. We help clients develop a “rapid response” plan to present to the court to ensure key information is preserved. Then, we create mirror image backups of targeted media to maintain integrity of evidence; all activity is carefully logged to maintain the admissibility as evidence of any findings.
